These Terms and Conditions of Use ("Terms") are entered into by and between you and PacinfraX ("Company," "we," or "us"). These Terms govern your access to and use of www.pacinfrax.com (the "Site"), including any content, functionality, and services offered on or through the Site.

Please read these Terms carefully before you start to use the Site. By using the Site, you accept and agree to be bound and abide by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site.

This Site is offered and available to users who are 18 years of age or older. By using this Site, you represent and warrant that you are of legal age to form a binding contract with PacinfraX. If you do not meet this requirement, you must not access or use the Site.

PacinfraX develops and operates sustainable High-Performance Computing (HPC) complexes powered by renewable energy. Our infrastructure integrates a state-of-the-art data center, solar and wind farms, and advanced battery energy storage systems (BESS) to fuel large-scale artificial intelligence (AI) training, scientific simulations, and compute-intensive workloads with minimal environmental impact.

This Site provides general information about our company, our green HPC infrastructure projects, and related services. All information on this Site is for general informational purposes only and does not constitute an offer to buy or sell any products or services, nor does it constitute investment or financial advice.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.

We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the Site and ensuring that all persons who access the Site through your internet connection are aware of these Terms and comply with them.

To access certain parts of the Site, you may be asked to provide information. It is a condition of your use that all information you provide is correct, current, and complete. You agree that all information you provide is governed by our Privacy Policy.

This information, including technical specifications (e.g., power capacity, Power Usage Effectiveness/PUE), performance metrics, and project timelines, is provided for general informational purposes only. It does not constitute a binding offer, commitment, or guarantee. All specifications are subject to change without notice.

Specific terms for any services, such as HPC colocation, AI training capacity, or infrastructure partnerships, will be governed solely by separate, negotiated written agreements (e.g., Master Services Agreement, Service Order). Any potential partnership or investment is subject to independent due diligence and separate contractual negotiations.

Your use of the Site, its content, and any information obtained through the Site is at your own risk. The Site, its content, and any services or items described or obtained through the Site are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, PacinfraX hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose.

All matters relating to the Site and these Terms shall be governed by and construed in accordance with the internal laws of the jurisdiction in which PacinfraX primarily operates, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the competent courts of that jurisdiction, unless otherwise required by applicable mandatory local law. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

The Terms and our Privacy Policy constitute the sole and entire agreement between you and PacinfraX regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
